If I Have A "Will", Am I Still Going To Go Thru "Probate" In Florida?

It depends!  If your only assets are ones that have beneficiary forms to them (such as IRA, 401(k)s, life insurance, etc.), then there most likely will not be probate in Florida.  However, if your assets do not have a beneficiary form to it and it is titled in your name alone, then when you pass away the assets will go thru the probate process in Florida.  Yes, that means even if my assets are not worth that much…you will probably still have to go thru the probate process!  Thus, there is a big misunderstanding out there in the public about how and when probate kicks in!
