Can I be fired for filing a workers’compensation claim? Workers’ compensation, commonly referred to as “workers comp”, is an insurance company program that nearly all employers in Florida are required by law to carry. The policy is in place to help cover medical bills and lost wages for any worker hurt at work regardless of who is at fault regarding the injury. An employer is not allowed to retaliate against you simply because you filed a workers’ compensation claim. This means they can’t legally fire you. Even if they threaten to fire you they can’t intimidate you or coerce you in any way. Firing or otherwise retaliating against an employee who files a workers comp compensation claim is against the law period.
