What Is Constructive Notice In A Slip and Fall Case?

I want to talk specifically in this video about negligence and in particular a slip and fall situation.

In order to have a slip and fall negligence action one of the elements that’s required is obviously damages that we talked about in other videos, but we also need to have notice and we talked in a prior video about what’s called actual notice. There’s another type of notice called constructive notice.

So what is that? Well, the best way is to describe it in this situation is to imagine that you’re in a grocery store again and there are eggs that break and they’re sitting on the ground and they end up sitting there for a while. What do I mean by that?  Well that’s really dependent on the situation, but let’s just imagine that it’s been down, sitting on the floor for 15 minutes. Well they should have some sort of procedure or policy in place at this particular grocery store to walk around and to make sure that it’s a safe environment and in that situation, 15 minutes, there’s yoke on the ground. It might be dirty from someone else stepping into it. That would be a situation where they should have done something about it and fix it, even though no one specifically told them about it. That’s called constructive notice.

I know it’s kind of confusing but it’s important that you understand the differences  I wanted you to be aware of tat.
