Will IRA 401K or Life Insurance Documents Go Through Court?

January 28, 2022

Hey guys, Attorney Andy here.

Here’s a question for you. If I have an ira a 401k, a life insurance policy, an annuity, or anything of that nature, and I pass away, will those assets go through the courts?

The answer is it shouldn’t, and the reason is because they have beneficiary forms. To them the problem is have you updated the beneficiary forms correctly to make sure that if you were to pass away that the person is alive to get your benefits or the benefits of those assets. It’s really important, otherwise guess what? It’s going through the courts because it’s going to go to the estate.

The point is this is stuff that needs to be checked out on a consistent basis every few years. You need to contact an attorney to protect your rights in regards to this estate planning topics. Contact us at 954-755-7803 and also check out askgandylegal.com. We have lots of free information on all different topics that you’ll find worthwhile.
