When you have a child, you have a death in the family unfortunately, maybe one of your relatives passes away and they may have been a beneficiary in your will. Those are the types of things where estate planning is important and you need to update things. The point is is that whenever there's something of importance that happens in your life it's usually a kicker to say I need to update my estate plan.

Well estate planning, in my opinion, is basically planning for a disaster. Now the disaster might be that you pass away or even worse, or maybe not worse but just as bad, you become disabled meaning you can't handle your finances or you can't make your own health care decisions. God forbid you're in an auto accident and you can't make your own health care decisions. Who's going to make those decisions for you?
The point is it's really important and it needs to be taken care of. The question next is why is it so important, and it's so important because you're leaving a mess for your family if you don't take care of it, so be responsible and really take care of your estate planning documents. You need an attorney to protect your rights and all these things.

Here's a question for you. What makes a will valid in the state of Florida? A couple of pointers here. Number one you have to be 18 years of age or older or you can be a minor as long as you were emancipated by the court. Number two, it needs to be in writing. Number three, it needs to be witnessed by two witnesses, not one, two witnesses, and the fourth thing is that you need to have the person that's creating the will, they need to sign it at the end and that's valid. It doesn't need to require a notarization or an affidavit, although that does help, and attorneys will do that for you because it's meant to help you in the long run.

And the answer is no, and you want to know why? Because a pet is considered property and you can't leave money to property. So what do you do? Well there's lots of ways to handle it, but one of the simplest ways to handle it is you can create some sort of a pet trust inside your will or inside the trust document where you leave money for the benefit of your pet and then you have someone supervise the money for you.

There's lots of documents that are important, but I'm just going to typically name what I feel, this is just my opinion, what I feel are the most important documents you need to have.
Either a will or a trust, you need to have a health care surrogate, durable power of attorney and living will. Those are the main documents. When do you get them? Well that depends on your situation, obviously, but again, the estate planning essential documents are a will or a trus,t durable power of attorney, health care, circuit living will.

So there's a big misconception out there and I wanted to kind of dismiss that misconception and the issue is only the wealthy need to have estate plans put into place, and that's not correct. My goal here is to make sure you understand that estate planning is meant for everybody, it's not just for the wealthy. You don't have to have a million dollars worth of assets to have an estate plan put into place. In fact, I always tell my clients that if you have a house and you have bank accounts, and you might have some other assets, it may not total a lot, but guess what? They're assets and we need to protect them in case God forbid something happens to you.
